Game Submission Terms

GAME SUBMISSION TERMS
PM Studios™ welcomes submissions from developers around the world. We review projects across genres, platforms, and regions, and we value the creativity and passion behind every game.

The following Game Submission Terms govern any projects that you submit to PM Studios™ for its consideration.

1. Non-Confidential Review
Unless we have entered into a separate written Non-Disclosure Agreement signed by both parties, and except as provided below in Section 7 (Personal Data), we do not owe any duty of confidentiality with respect to any materials or information that you may provide in connection with any project submission, even if any materials or information are marked “confidential”.Please do not include any confidential information of a third party in your materials.

2. No Obligation
Submitting your project does not create:
- A partnership
- A joint venture
- An agency relationship
- A publishing commitment
- Any obligation to fund, develop, market, or release your game

Any business relationship between you and us will arise only through a separate written agreement signed and delivered by both parties. Unless and until such agreement has been executed and delivered by both parties, neither party will have any obligation whatsoever with respect to your project submission, except as otherwise expressly provided in these Game Submission Terms.Each party has the right to terminate discussions regarding your project submission at any time and for any or no reason.

3. No Liability
PM Studios™ is actively engaged in developing, publishing, and distributing games across different genres and themes and regularly receives project submissions from many different sources, which may include ideas, concepts, and other materials that may be similar to or coincident with your project.Therefore, you agree that we will not be restricted from, or liable for, pursuing any of our present or future business activities or entering into any agreement or transaction of any kind with any third party, regardless of whether the subject matter of any such business activities, agreement, or transaction involves elements similar to or coincident with your project submission.

4. Limited Evaluation License
By submitting your materials, you grant PM Studios™ a non-exclusive, worldwide, royalty-free license to internally review, evaluate, and discuss your submission for publishing consideration. No commercial rights are granted to us unless a separate written agreement is executed by both parties.

5. Representations and Warranties
You represent and warrant that:
- You exclusively own all right, title, and interest in and to the materials submitted.
- You are authorized to submit the materials on behalf of your team or company.
- The materials submitted do not infringe, misappropriate, or violate the intellectual property or other rights of any third party.
- The materials submitted do not contain confidential information belonging to any third party.

6. Moral Rights (Where Applicable)
To the extent permitted by applicable law, you waive and agree not to assert any moral rights in the submission in connection with PM Studios’ evaluation of the project.

7. Personal Data
Personal data provided through the submission process will be processed in accordance with our Privacy Policy. Submissions may be reviewed by teams located in multiple jurisdictions, including the United States.

8. Indemnification
You agree to indemnify and hold harmless PM Studios™ and its shareholders, directors, officers, employees, and agents from any demands, claims, actions, and proceedings (whether criminal or civil, in contract, tort or otherwise) for losses, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:- Any materials that you submit.- Any alleged infringement, misappropriation, or violation of the intellectual property or other rights of any third party.- Your breach of any of the terms and conditions of these Game Submission Terms.

9. Governing Law; Exclusive Jurisdiction
These terms are governed by the laws of the State of Nevada, USA, without regard to any conflict of law principles. The courts of the State of Nevada, USA, shall have exclusive jurisdiction over any action brought to enforce these Game Submission Terms, and each of the parties irrevocably:
(a) submits to such exclusive jurisdiction for such purpose;
(b) waives any objection which it may have at any time to the laying of venue of any proceedings brought in such courts;
(c) waives any claim that such proceedings have been brought in an inconvenient forum; and
(d) further waives the right to object with respect to such proceedings that any such court does not have jurisdiction over such party.

Notwithstanding the foregoing, application may be made to any court of competent jurisdiction with respect to the enforcement of any judgment or award, or the pursuit of injunctive or other equitable relief.
